Terms & Conditions* VENDOR agrees (a) that it will not share it’s booth with any other brands/labels/companies/businesses without written consent from Event Organizer (b) It will not use any amplified voice and/or music amplification system in its area. and (c) that interior furnishings and materials in the vendor areas shall not be located so as to obstruct or block exit ways, fire and safety devices or similar equipment.
VENDOR acknowledges that the Event Organizer reserves the right to modify the event date, time, location, or physical presence and hold a virtual event if absolutely necessary. The Event Organizer also reserves the right to ask any VENDOR employee to leave the Errl Cup Event who is unruly or violates any rules of the Errl Cup Event.
VENDOR acknowledges and agrees that (a) this is a marijuana event and there will be medicating at the Errl Cup Event. (b) That only Valid Medical Marijuana cardholders are allowed to attend the event.
VENDOR agrees that except in the event of the Event Organizer’s gross negligence, the Event Organizer will not be liable for refunds or any other liabilities whatsoever for the disruption of the Errl Cup Event due to the location in which the Errl Cup Event is to be held being destroyed by fire or other calamity. Or by any act of god (including but not limited to weather, public enemy, police, illness not limited to but including COVID-19, political, terrorist strikes or any other similar causes out of the Event Organizer control.
VENDOR acknowledges and agrees that (a) in order to comply with the smoking ordinance of the Department of Public Health, smoking is only permitted in the area the Errl Cup Event is held. (b) by law, individuals are not allowed to bring alcoholic beverages onto the property where the Errl Cup Event is held, and (c) it must obtain and maintain an insurance policy in form reasonably acceptable to the Event Organizer and provide the Event Organizer with a copy of such insurance policy or a certificate of liability insurance.
VENDOR agrees to permit photographs and video to be taken of vendor village areas by the Event Organizer or its representatives at the Errl Cup Event to be used for the purposes of promoting and advertising the Errl Cup Event. All such photographs and video footage remain the property of the Event Organizer.
VENDOR, its employees and associates are voluntarily participating in this Errl Cup event and related activities. VENDOR understands that there are risks associated with participation in this Errl Cup and related activities, such as physical and/or psychological injury, pain, suffering, illness not limited to but including COVID-19, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Errl Cup location (s) or facility (ies) or other. Nonetheless, VENDOR, its employees and associates assume all risks of participation in this Errl Cup and related activities, whether known or unknown, including travel to and from the Errl Cup (including air travel) or any events incidental to this event.
VENDOR, its employees and associates agree to hold the Errl Cup, its associates & event facility harmless from any and all claims, loss or damage to their person, household members, personal property, liabilities and costs, including attorney’s fees, as a result of participation in this Event and related activities, including travel to and from the Event (including air travel) or any events incidental to this Event.
Each party represents and warrants that (a) it has the authority, power and right to enter into and deliver this Agreement and perform its obligations hereunder; (b) it will not enter into any agreement with any third party that conflicts with the terms of this agreement and is not subject to any such agreement currently.
This Agreement constitutes the entire agreement between the Event Organizer and VENDOR. No amendments to this Agreement shall be valid unless agreed to by both parties hereto in writing. This Agreement shall be interpreted, construed, and enforced in accordance with the local law of the State of Arizona.
In the event any provision of this Agreement is held to be illegal, in valid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that this Agreement otherwise remains in full force and effect
